Terms & Conditions of Sales

 

These conditions apply to products of the collection De Milan ("Products"), and are an integral part of the sales contract between the seller ("We", "Us") and the customer ("You").


You may not transfer your rights under the contract between us and you to any third party without our prior written consent.
We may amend and update these conditions from time to time. Any changes in the future will be posted on this page. The date of the latest update to these conditions is set out at the top of this page.

 

 

1.  Use of the site and account


You shall not use the website in a manner that could cause it to be impaired, damaged or interrupted in any way.
You shall not modify, reverse engineer or create derivative works based on the website.
By opening an account or purchasing products on our site, you acknowledge and agree that:

  • You are not using another person or entity name, a false name or a name that you do not have permission to use.

  • The information provided to open your account is true, accurate and current. You can make changes when necessary by logging in or contacting our online service.

  • You are responsible for the confidentiality and maintenance of the information and password of your account and you accept responsibility for all activities that occur under your account and password.

It is important that you keep your personal information and password confidential and secure, if you suspect that your password has become known to someone else or was likely to be used without your permission, please contact us immediately: we will not be liable to any person for any loss or damage because you did not protect your password or account details.
We reserve the right to refuse a sale, refuse service or access to the website to anyone, to close personal accounts for any reason and at any time, and we will not be liable to any person or business because of these actions.

 

2.  Prices and payments


The price to be paid for the Products is the price shown in the product pages at the moment of the order.
The Products are delivered free of charge to all countries in Europe (excluding any island other than UK and Ireland) and USA (excluding Alaska and Hawaii).
For all locations not included above the delivery could be subject to a delivery charge, added to the sale price. This charge can be seen during the purchase process before proceeding with the payment.
Extra delivery charges may apply in some special circumstances (see paragraph 7. Shipping).
The total price of the Products (including delivery charges, when applied), as shown in the order confirmation, must be paid in full at the moment of the order: We will not proceed with the production and delivery of Products until we have received all amounts stated.
We reserve the right to change prices of the Products at any time, without prejudice to existing orders, which will be completed at the price in effect at the time of the order.

 

3.  Local taxes and custom duties


The price paid for the Products includes any sales taxes and/or VAT of any country of delivery.
Customs duties applicable on delivery to any country other than the EU or the United States are not included in the sale price and must be paid to local authorities by the consignee of the goods.
Depending on the country for which you require the delivery, it is your responsibility to know and be prepared to take care of these expenses.


 

4.  Changes & Cancellations

 

a)  Purchases of Products "in stock" may be cancelled at any time prior to shipping.

b)  Purchases of Products "made to order", according to the rules of distance selling cannot be cancelled. However we adopt a more flexible policy, by providing a cancellation period also for “made to order” purchases, as follows:

  • You can cancel your order within 7 calendar days from the day of the order (including the day of the order), with a penalty fee of 5% of the total sale price, to cover our credit card processing costs.

  • You can cancel your order from 7 to 21 calendar days from the day of the order (including the day of the order), with a restocking penalty fee of 20% of the total sale price.

  • After 21 days calendar days (including the day of the order) orders cannot be cancelled as preparation of the order is too advanced.

All refunds for cancelled orders will be made as described in paragraph 11.


 

5.  Coupons

 

We may, at our sole discretion, provide our best customers with free Coupons.
Coupons are codes that can be inserted in a special box during the checkout for a percentage discount on the price of the purchase.
Coupons cannot be used by a client signing as a guest; cannot be transferred; have a variable expiry date; cannot be cashed-in; do not entitle their holders to any form of compensation directly or indirectly relating to the lack of use of them in their period of validity.


 

6.   Gift Vouchers

 

Gift Vouchers are written certificates sent electronically, representing a credit towards future purchases, that can be used to purchase products only on this website and cannot be cashed in.  

Only one Gift Voucher can be used for each purchase.

The value of the Gift Voucher used for a purchase cannot exceed the cost of the product purchased once personal Reward Points have been deducted from its price.

Each Gift Voucher can be used only once, has a validity of 12 months from the date of the issue;  the holder will not be entitled to any form of compensation, directly or indirectly related to the lack of use of it in its period of validity.


 

7. Shipping


The estimated shipping time of each product is shown in the Product page.

The Products will be delivered at the ground floor and the standard method of transportation is by boat and truck. If you prefer air freight shipping, you can notify us by e-mail by clicking on “Contact Us” at the bottom of any page. Please be aware that this type of delivery, although quicker, is far more expensive, especially for large items, therefore we will be obliged to notify you the additional costs for it, that must be agreed by You and paid in full before we proceed to organize it.

 

When placing your order you must tell us about any special factors that can cause difficulties in delivery, such as parking restrictions, narrow bridges, narrow or unpaved roads, by using the "delivery instructions" field provided for this purpose at the checkout.

You could be charged if the delivery is more costly and/or takes longer than it otherwise would have because you failed to tell us about these factors.

 

You will be informed of the date of delivery to your address 7 days before the shipping of the Product:  if you want to move the date of shipment, you have special needs for the delivery date or you want to change your delivery address, you must inform us within the next 24 hours, by clicking “Contact Us” at the bottom of any page:  if you do it later it may be necessary to organize a new delivery, with a cost to you, which must be paid before we proceed.

 

If you or a person nominated by you, that must be above the age of 18 years, are not available at the time of delivery, for security reasons, We cannot leave the goods unattended at your address and we will have to arrange a new delivery, at a cost to you that must be paid before delivery can take place.

 

If delivery is not feasible, we will ask you to provide an alternative delivery address to redeliver the goods. If we do not hear from you with a suitable alternative delivery address within 7 days of the attempted delivery, we may cancel and refund your order, and deduct a charge for our administration, transit and storage costs of 25% of the total sale price. Delivery charges applied will not be refunded. 

 

We will not held responsible for delays in delivery due to fires, floods, strikes or other labor disputes, acts of God, acts of any governmental authority, riot, embargoes, acts of war or terrorism, shortage of fuel or energy, accidents or transportation delays, difficulty in obtaining labor or materials from the usual sources, or any other cause beyond our control (Force Majeure).  If one of these events occurs, we may, at our convenience, extend the delivery date for the time required to overcome the cause of delays or cancel the order, with the refund of the full price paid.


 

8. Damages


All our Products are 100% Made in Italy, manufactured and assembled in our facilities and are carefully inspected and checked before shipment.  
Once our Products leave our facilities, the shipping company will become liable for any damages occurring during shipping or storage. 

It is your responsibility to check all goods upon delivery:  if packaging is opened or badly damaged, you can refuse delivery, by making a claim to the shipping company.

In the unlikely event that the Product has a defect or damage not visible at the time of delivery, you can report the damage by clicking “Contact Us” at the bottom of any page within 24 hours of delivery, and we will arrange the replacement of the parts damaged or the entire Product.

The absence of complaints within the prescribed period constitutes acceptance of the goods and a waiver of any claim for defects, errors or failures.


 

9. Repairs and Replacements


To qualify for repair or replacement, Products must be returned in their original condition. Products assembled by you must be dismantled and packed carefully, glass tops must be returned in their original wooden case.
Once the Product has been received and verified, if it is suitable for replacement, we will send a replacement as soon as possible.
The correction of defects within the warranty period represents the full payment of all our obligations regarding the Product sold:  customers do not have the right to a rebate or any other form of compensation, directly or indirectly related to the lack of use of the product, for the time required to replace the defective product or its components.


 

10. Returns

 

a)   Products "in stock" can be returned within 15 calendar days from delivery.

  • To return Products, you must send an email by clicking “Contact Us” at the bottom of any page indicating the Product you wish to return together with your order code in order to receive authorization and instructions for returning the merchandise:  unauthorized returns will be automatically rejected.

  • Products returned damaged by you will not eligible for reimbursement.

  • To be eligible for a refund, you must return the Product in perfect condition:  if the product was assembled by you, you must disassemble it and carefully repackage its parts, re-using the original packaging where possible, glass tops must be returned in their original wooden case.

  • Until Products are received by us, you will be responsible if they are lost, damaged or destroyed.

  • Once we have received and inspected the Product, if it is eligible for a refund, we will refund the price paid less the cost of return shipping, (usually an amount similar to the costs of the original shipping to you), and deduct the cost of any wooden cases for glass tops if they are not returned.

  • The refund will be made according to the procedures described in paragraph 11, and will imply the loss of loyalty points related to the purchase refunded.

b)  Products "made ​​to order" cannot be returned.


 

11.  Refunds


For security reasons, we can only make repayments to the same account you used to purchase your order.
This means that if you used a PayPal account for payment, the money will be refunded to your PayPal account, if you used a credit card or debit card, the money will be refunded to the card used.   According to the circuit, this process can take up to 30 days.


 

12.  Assembly


For transportation reasons, some Products are shipped unassembled.  However, Products that require assembly have been designed to be easily assembled without the use of any special tools or special knowledge.
Easy and precise assembly instructions are supplied with the Product, we are not responsible for any damage to persons, property or the Product itself due to incorrect assembly or installation methods.


 

13.  Design and Patent Rights

 

All products of the De Milan collection are produced by Nextra Srl (VAT no 015662600335), a Limited company with registered offices in Piacenza, via Felice Frasi 3, that also holds the rights for worldwide distribution and the managing of the website.

 

All measurements are approximate. The manufacturer reserves the right to make changes in the size, design, and construction without notice, without affecting existing orders, which will be completed as shown at the time of the order.


 

14.  Warranty


All our Products are carefully checked before packaging to ensure they are free from defects in material and workmanship, and are supplied with a certificate of authenticity and a limited warranty according to their material and use.

Each product has a specific warranty based on its type and utilization, and suggested maintenance and cleaning instructions that must be implemented for the warranty to be valid.

If a product fails its warranty during its period of validity, upon written invitation, We will repair or replace, at our discretion and expense, the nonconforming parts or the entire Product.

 

The warranty does not apply in the following cases:

  • Damage to the Product due to inadequate methods of unpacking.

  • Damage to the Product due to inadequate methods of assembly.

  • Damage to the product for misuse or improper installation.

  • Other materials not produced by Us and used in the Product.

  • Poor maintenance of the Product, including the use of methods of cleaning and washing not recommended by the manufacturer.

  • Normal wear and tear.

  • Exposure of the Product to unusual conditions or extreme temperature changes.

  • Natural changes in surface finishes, including color due to aging or exposure to light.


 

15.  Limitation of Liability

 

We  will not be liable for any special, incidental or consequential damages (damages resulting from an act, but not directly connected to it) due to improper assembly, installation or use of the products or part of them.
